Patent and therapeutic intellectual property valuation

Specialized healthcare intellectual property requires a clear definition of the asset, its development status, and the rights being valued.

Define the asset and commercial rights

The assignment identifies the technology or rights at issue, the intended use of the valuation, and relevant territories or applications. Ownership of an asset and a license to use it can present different valuation questions.

Examine the economics and uncertainty

Depending on the assignment, relevant considerations can include potential markets, development and commercialization timing, remaining investment, and uncertainty in future outcomes. We identify the assumptions that need analysis and the evidence available to support them.

Evaluate licensing and ownership structures

Where relevant, the analysis considers the economics of royalties, milestone payments, and other contractual terms. Comparable licenses and projected economic benefits can inform the work when they are appropriate to the subject rights.

Make the reasoning understandable

A specialized asset can require substantial research and judgment. We explain the selected methods, material assumptions, and sensitivities so the client and its advisors can understand what drives the valuation.
